Terms and Conditions of Contracting
The present conditions regulate the contracting of web design, development services, and digital products offered by VLCTienda.
1. Object and Contracting Process
The object of the service is the creation, design, development, or delivery of websites, software, or digital products according to the specifications agreed upon in the quote accepted by the client. Acceptance of the quote implies full adhesion to these terms.
2. Exclusion of the Right of Withdrawal
In accordance with Article 103, paragraphs c) and m) of the Spanish Royal Legislative Decree 1/2007, of November 16, which approves the revised text of the General Law for the Defense of Consumers and Users, the 14-day right of withdrawal SHALL NOT apply to the services contracted on this website for the following reasons:
- For custom-made projects: The services consist of goods/services made to the consumer’s specifications or clearly personalized (custom web design and development).
- For digital products and licenses: The services consist of the supply of digital content which is not supplied on a tangible medium, where the execution has begun with the consumer’s prior express consent and their acknowledgment that they thereby lose their right of withdrawal once the download or access to the service has started.
Therefore, once the quote is accepted, the initial payment is made, or the execution of the service/download has commenced, no refunds will be issued for withdrawal.
3. Intellectual Property and Delivery
The intellectual property of the codes, designs, and the final website will be exclusively transferred to the client only and when all agreed invoices have been paid in full. Until that moment, the developer retains full ownership of the work performed.
4. Warranty and Support
A technical warranty of 30 calendar days from the formal delivery of the website is offered to correct any detected programming errors or bugs. This warranty shall be void if the client or any third party external to the developer tampers with the source code, database, or internal configuration of the website.
